A Trial May Not be Necessary

In Minnesota, legal separation prior to officially filing for divorce is not required. The state does require a “financial early neutral evaluation” (FENE) of the entire marital estate for every impending divorce, as well as the requirement of a “social early neutral evaluation” (SENE) provided there are children involved. The outcomes of these evaluations are not concrete, but they absolutely can be considered in the court. Additionally, mediation is always required in any contested divorces.

Mediation and third-party evaluations can provide a strong opportunity to resolve your divorce case without the necessity of a trial. These allow families to reach agreements without the additional stress of a trial–which is essentially leaving the fate of you, your children and your assets to strangers.
